STRATTON MOUNTAIN ASSUMPTION OF RISK
I understand and am aware that skiing and snowboarding are HAZARDOUS activities and I accept and clearly understand that there are
inherent and other risks involved in the sport of skiing or snowboarding for which this pass is used. Those risks include, but are not limited
too, skier collision with padded and unpadded objects including natural and man-made objects or other skiers or snowboarders, varying
terrain, weather, snow conditions, ice, maintenance vehicles and many other hazards. I also understand that increased speed means
increased danger and risk of injury.
As a condition of being permitted to use the ski area premises, I freely accept and voluntarily ASSUME ALL RISKS of any injury, death or
property damage of any type resulting from conditions of the premises, operations of the ski area, actions or omissions of employees or
agents of the ski area or from my participation in skiing or snowboarding at the area, accepting myself the full responsibility for any and all
damage or injury of any kind which may result. I further agree to HOLD HARMLESS AND INDEMNIFY The Stratton Mountain Resort and its
employees from any and all liability for death and/or personal injury, medical or other expense or property damage to myself or others
resulting in any way from my use of the ski area premises.
I further agree that (1) any claim, which I may at any time bring for any reason against The Stratton Mountain Resort, its employees and
agents, shall be submitted to the jurisdiction of the State or Federal Courts of the State of Vermont and that no claims or actions shall be
brought in any other jurisdiction; and (2) any claim shall be governed by the laws of Vermont.
I HAVE CAREFULLY READ THIS AGREEMENT BETWEEN MYSELF AND THE STRATTON CORPORATION, FULLY UNDERSTANDING ITS CONTENTS
AND I AGREE TO SIGN IT OF MY OWN FREE WILL. (If under the age of 18, must be signed by a Parent/Legal guardian.)
By signing this AGREEMENT as Parent/Guardian I am consenting to his/her skiing and/or snowboarding on the premises of The Stratton
Mountain Resort and I acknowledge and understand that any and all risk, whether know or unknown, is expressly assumed by me and all
claims, whether known or unknown, are expressly waived in advance. Further, I acknowledge and understand the terms and conditions of
this Agreement, and agree to be bound by those terms and conditions.
RULES OF PLAY
Refund policy: The Passholder(s) acknowledges that Season Passes, Flex Cards and Seasonal Snow School Programs are non-refundable and
non-transferable and are to be used within the season they are purchased for. Any exceptions to this rule are at the discretion of Stratton
Mountain Resort and applicable usage and administration fees will apply. Stratton Mountain Season pass and Flex Card holders must be
aware of the rules of play, it is your responsibility. By using your Pass (any Season Pass or Flex Card) you are agreeing to the terms and
conditions listed below:
-Your Pass is for your personal use only. It is not transferable and is not available for resale.
-Fraudulent use of pass or violation of mountain polices may result in legal prosecution and/or loss of lift privileges and may
be subject to fines of up to $5000. Theft of Service 13, V.S.S. Section 2581 and 2582. You are liable for any misuse while the
pass is not in your possession unless you have already reported your pass lost or stolen prior to the misuse.
-Respect the mountain. Respect Others. Respect yourself. Any breach may lead to removal from the mountain and loss of
Pass privileges. Respect gets respect. You must abide by the Alpine Responsibility Code at all times. Any breach may lead to
temporary or permanent loss of privileges.
-You are responsible for reporting if your Pass gets lost, stolen or damaged right away. If you lose your Pass or forget your
Pass at home you can receive one free reprint, upon presentation of valid ID, with additional replacements for a fee.
-For security reasons you will be required to show valid ID when you pick up your Pass.
-You must have your Pass on you at all times when accessing Stratton Mountain --no exceptions.
